TERMS & CONDITIONS

1- General
These terms and conditions shall apply to all orders placed by customers (hereinafter referred to as "you") via the FK Lingerie website, telephone website or application from Kayabaş Teksti San. ve Tic. Ltd. Şti. (hereinafter referred to as "FK Lingerie" or "we") with trade registry number 570330-0.

By using fklingerie.com and/or placing an order, you agree to be bound by the terms and conditions set forth herein. Please read the terms carefully before placing your order.

Only persons aged 18 or over, excluding TRNC, who are not under guardianship and do not act as a legal entity, and postal forwarding agencies may place orders.

The inclusion of any product or service on fklingerie.com at a particular time does not imply or guarantee that such products or services are available at any time. We reserve the right to discontinue the sale of a product at any time.

We reserve the right to change these Terms from time to time without prior notice to you. The terms that apply to the order will be the terms available on fklingerie.com at the time you place your order.

FK Lingerie aims to provide you with the best possible online trading experience. To make this possible, we must ensure that our services operate without any disruption. You agree and acknowledge that you will not (i) publish, disseminate, distribute, upload or promote any content or material that could harm or adversely affect our business, products or services; (ii) act in a manner that restricts, inhibits or obstructs other users from using the Hofsilk.com site or adversely affects the security of the site; or (iii) use any device or attempt to use any engine, software, tool, system, program or other device or mechanism (including spiders, robots, bugs, avatars or intelligent agents) to navigate or search the site or to copy content from the site. We reserve the right to immediately ban any user from accessing the site and to terminate the account of any user who violates this or any other provision of these terms and conditions.

2- Prices and shipping costs
Prices shown on fklingerie.com include statutory VAT and exclude shipping costs. The shipping cost for each order will be the same regardless of the size or weight of your order. The price for each shipping method is clearly stated when paying for the order. If we cannot deliver your order in full at once and have to deliver it in multiple shipments, no additional charge will be made for subsequent shipments. Prices stated in the store, in the catalogue and on the internet may vary.

3- Placing an order / making a contract

When you place your order, if you have provided your email address, you will be sent a confirmation email. If for any reason your order cannot be fulfilled, you will be informed at the earliest opportunity. If you have made a payment for this order, the relevant amount will be refunded to you using the same method used to make the payment. If for any reason an alternative transaction is required, an FK Lingerie representative will contact you to discuss the refund.

4- Shipping
FK Lingerie takes the utmost care when receiving and processing orders and will make every effort to deliver your order to a residential address in Türkiye, according to the shipping method you have chosen.

FK Lingerie makes every effort to ship orders as quickly as possible and in the order they are ordered. Unless otherwise agreed, your order will be delivered within 7-9 business days, excluding Sundays and holidays, if placed by 16:30 on weekdays, with the confirmation of your order. On the other hand, although the delivery is intended to be made within the specified time frame, this period may be extended due to unexpected events. If the delivery period exceeds 30 days, even if it is not expected at all, you can cancel your order.

Our manufacturing time for your custom orders is 7 to 9 business days. After your product is manufactured, you will receive it within 10 to 15 business days.

From time to time, we share our collections with you before the sale date and take pre-orders. Delivery times for pre-order products will start after the sale date announced on the sales page of the relevant collection and product.

Before placing your order, you will be informed of the details of the expected delivery. When placing your order, if you have specified your email address, you will receive an SMS and a confirmation email with the details of the expected delivery.

5- Cancellation of Order by Customer
You can cancel or return an order up to 14 days after the date you placed your order and the product you ordered reaches you. If you have paid for the products, you will be refunded if a product return fee has occurred. You can find all information about the return procedure at hofsilk.com.

If you want to cancel or return your order, you can initiate your return process by submitting your return request via fklingerie.com, adding your order number, order email, and the reason for return.

You can send the product package you have prepared together with your invoice to our return address at Sururi Mahallesi Çeşnici Sok. No:15 Fatih İstanbul, free of charge through a contracted cargo company or at your own expense through other cargo companies.

Provided that we receive the products or a document proving that you have sent them back, we will refund you as soon as possible or within 14 days of receiving your cancellation notice, using the same payment method you used to make the payment.

6-Order Cancellation and Return Conditions/Exceptions
FK Lingerie undertakes to refund the full price of all products returned in accordance with section 5 (Order Cancellation), provided that all products are returned in the same condition as they were received by you. In this context, the products must not be damaged, spoiled, faded, tampered or worn (except for use for testing purposes), and their labels must be intact and complete.

It is not possible to return products that are prepared according to your request or personal needs, even if they are unused, underwear and all its derivatives, single-use products, products that have undergone changes in shape, damaged products, products that are not suitable for return in terms of health and hygiene if they are opened after being delivered to you. In order for products such as personal use products, underwear products, etc. to be returned, their packaging must be unopened, untested, undamaged and unused.

For hygiene reasons, panties, thongs, bodysuits and swimsuits cannot be exchanged or returned.

7- Payment methods
You can pay for the products in different ways as stated below.

Credit card or debit card
You can enter payment information at the time of placing your order using a valid credit or debit card: (VISA, MasterCard or Amex). The relevant amount will be deducted from your card immediately. FK Lingerie has the right to check the validity of the credit or debit card, the credit status regarding the order amount, and whether the address information of the recipient is correct. Depending on the results of these checks, orders may be rejected by us.

You are obliged to provide a correct e-mail address and to inform FK Lingerie if your e-mail address changes.

8- Our Limit of Liability
Nothing in these Terms will exclude or restrict FK Lingerie's liability where it would be unlawful to exclude or limit our liability.

FK Lingerie accepts liability for death or personal injury resulting from negligence on our part or our employees and officers. We are responsible for any erroneous statements and information made by us or our employees or officers.

In the event of a breach of these Terms, we will only be liable for losses that are a reasonably foreseeable consequence of such breach.

FK Lingerie is not liable for any indirect losses that are a side effect of the main loss or damage, such as loss of profits or loss of opportunity; or for any failure to perform any obligation under these Terms or to deliver goods due to events beyond our reasonable control, including fire, flood, storm, riot, civil unrest, war, nuclear accident and terrorist acts.

Our maximum liability to you for any loss or damage arising in connection with an order placed through fklingerie.com will be limited to the total price of your order.

If you are experiencing a problem with a product you purchased online from FK Lingerie and you are unable to resolve your issue with FK Lingerie, you should submit your complaint to the Consumer Arbitration Board.

9- Colors and sizes
We make every reasonable effort to accurately display our product features, including product composition and colors. The color you see will depend on your computer system and we cannot guarantee that your computer will accurately display these colors.

The measurements of a product shown on fklingerie.com are approximate values ​​for the purpose of providing a better understanding of the model or cut of that product, and there is no guarantee that the exact dimensions of the product you receive will be the same. The final dimensions of a product may vary depending on the material used in its production.

10- Product Warranty
If the products you have purchased are defective, FK Lingerie will fulfil all applicable mandatory warranty regulations. If you have a complaint that the products we have sent contain obvious material or manufacturing defects, including damage during transport, please inform us and return the products without delay using the return link on hofsilk.com.

11- Transfer and Assignment
FK Lingerie has the right to transfer or recourse to third parties any claims that may arise in connection with the delivery of the goods, including payment installments.

12- Divisibility
If any part of these Terms is held to be invalid by law or held to be invalid by any court or regulatory authority, the remaining Terms will continue in effect.

13- Entitlement
All intellectual property rights, including trademarks and copyrights on fklingerie.com, remain with Kayabaş Teksti San. ve Tic. Ltd. Şti. and its group companies or licensees. Any use of fklingerie.com or its content other than for your own personal, non-commercial use, including copying or storing this content in whole or in part, is prohibited without the permission of FK Lingerie.
